Darren Morgenstern is a world class scumbag who manages to get away with committing all sorts of frauds, scams and criminal activities. I know this for sure because he stole/scammed thousands of dollars in cash & equipment from a company I used to work for. He even wheeled out our printer and jumped onto the elevator with it after we bought it from him. The police said it was a 'civil matter' and we never did get it back. He also ran a cell phone scam by selling phones/plans and keeping them registered in his name so that one paid, but never owned the phone.

Private marriage contracts are the solution. Couples should negotiate the terms of their own union. Most, I suspect, would settle on the traditional ideas (the one at fault being punished).

The recognition of private marriage contracts is all it would take to overthrow no-fault, and there would be so organized resistance to it, since it wouldn't be forcing anyone to do anything. You could even have a no-fault divorce if you wanted.

If you, or anyone you know, is getting married, have the sign their own marriage contracts. There is a good chance they will have to be recognized by courts, much like pre-nups.

Fuck that dude. Make it no fault and no pay. That is the way to do it. When people break up government doesn't do anything. Nothing happens. There is nothing owed.

Miles you are right. According to this fresh off the press article, not only do evil laws make people do evil things, you now have evil lawyers sitting on chairwoman positions in state judicial committees, ready to kill off any divorce reform bill which can be bad for their business:

"possibly bring the concept of alienation of affection back into play. If a few people can sue the guys for millions of dollars for helping to destroy families, then we may be able to reestablish precedent for civil liability in adultery cases. "

EXACTLY.....................I have multiple friends who have "lost" their wives to other men. Im thinking of 4 or them right now. They still had to pay child support, divided the assets, ordered to pay off her car....................so she could go be with someone else. These were great guys. Why on earth can't they sue this "new man" who stole their wives from them?

"Alienation of Affection" is a very sound concept, isn't that precisely what happens when a new woman "steals" a husband from her wife? The wife, left all alone, while the husband is out cavorting with the secretary or whatever. If someone is no longer "in love" and wants a divorce, then they should have to go to the court and tell the court just that, none of this "we met and we just couldn't help ourselves, it was meant to be, we are soulmates" crap.

In my opinion, if a man has kids, and his wife leaves him for another man (3 of these guys had kids), then that new man knew what he was getting into by absconding with her. HE should be liable for their support, not the real dad. He knew what he was getting into...........he knew about her kids, why does "dad" have to pay her hundreds every month so she can move in with someone else?

BTW....................Only one of those couples is still together, and that one is miserable and broke (and both are getting fat). People who cheat and leave rarely find lasting happiness. It seems most dont last a decade. What I really love about one of the situations is that she had to split her assets when her paramour/new husband was cheating on her (and getting another woman preggers) AGAIN from the first divorce......................she is 40 years old and basically "starting over". She had bought him a motorcyle, truck, they bought a boat, did the expensive vacations, all of that. He now has 3 kids out of wedlock, and was cheating on her that last two years they were together. Her ex, my pal, is happily remarried and is off the market...............................so there she is, a middle-aged woman whose kids dont respect her (or even like her anymore), are teens (that child support will be ending in about 5 more years), and is broke and starting over.................all for a guy with a ponytail in his 30's.

The fear of an "Alienation of Affection" lawsuit would have kept this assistant softball coach from making moves on the head coach's wife I think (thats how they met, can you friggin' believe that?). My friend, when the affair was going on, had his phone tapped by a detective. He relayed to me some of the details of the conversations and it was sickening. The two of them were talking about how much money they could "take him for", and how much he'd have to pay. They thought they could basically get an entire house-note worth of money out of him every month for a good 10 year period, plus the house, plus half his 401K (since neither of them had saved a dime for retirement), plus he'd have to pay off her present car. It was disgusting. If this schmuck was worried about being sued.................I doubt that whole affair would have happened.

Evil laws put evil incentives in front of average people and get them to do evil things.

No Fault divorce is here to stay. It will never be purged. The outcry from women's groups would sink any politician who tries it.

Like it or not, the nuclear family is dead. Heck, the more Sanford talks about his adultery, the more women love him (and men despise him). It's the Bill Clinton strategy -- Bubba-ize it! And it works.

Women LOVE icky sex, soap opera relationships, infidelity (which is exciting to them) and so on. Yeah Sanford is alienating his male Republican base, but women are starting to come around for him, the more he talks and sobs.

We already see "Dexter" (a "good" serial killer -- he releases his sadism by only killing other killers) as a romantic lead in a show watched almost entirely by women. Plus adultery and such galore as 'hot' plot points for women's shows, and commercials denigrating husbands as doofuses who are replaceable by cash or stunt grooms (check out my website's latest post for examples).

We can't change -- that tipping point already happened, we have to simply manage our downward descent and the resulting single motherhood model for all but the wealthy.

If Fault becomes a factor again in divorce custody, asset division, alimony decisions (in some states it still is; others like AZ are considering bringing it back), then I see Ashley Madison becoming a one-stop-shopping for divorce subpoenas. With their use of credit cards for membership paymnet, it is undisputable evidence.

The other future scenario is that after AM goes under (eventually most businesses do), their mailing list gets sold, and resold to shady "enterpreneurs" who may try to mine it for various purposes (i.e. blackmail).

There may be justice for the wronged spouses yet. Just not the kind of justice that you and I are used to.
